JON-DON CLASS POLICIES

1. DEFINITIONS

"Classes" refers to any classes, workshops, courses, seminars, or events provided by Jon-Don to you in your order confirmation. "We/Us/Our" refers to Jon-Don. 

2. TERMS AND CONDITIONS

By accessing or otherwise using this website you agree to the terms and conditions described herein. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms & Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the class following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes.

3. ERRORS, INACCURACIES, OMISSIONS

Information on our website may contain typographical errors, inaccuracies, or omissions that relate to class descriptions, pricing, promotions, offers, and scheduling.  We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice (including after you have submitted your order).

We make all reasonable efforts to ensure that all prices shown for classes on our website are correct at the time they are published. We reserve the right to change prices and to add, alter, or remove special offers at our discretion.

4. REGISTRATION FEES, PAYMENTS, & SALES TAX

Classes are available exclusively to customers within the United States and enrollment will be canceled and refunded should a purchase from outside the USA be identified.

In-person class tuition includes manuals or other class documentation as provided by the instructor as well as demo supplies, lunch, and refreshments. Live stream tuition fee includes digital manuals or other class documentation as provided by the instructor. Students are responsible for providing their own Internet connection, laptop, webcam, and audio connection for Live Stream classes.

Payment for classes is due via credit card at the time of registration. We accept Visa, Mastercard, American Express, and Discover.

All applicable sales tax as required by law will be collected at the time of registration.

The customer understands and agrees that the charges on a credit card or check for any products purchased through Jon-Don are irrevocable, undisputable, and may not be charged back, contested, or challenged now or in the future. Jon-Don reserves the right to seek attorneys’ fees and costs associated with addressing a chargeback, in addition to the amount challenged.

5. CANCELLATIONS

All class registrations, including on-demand classes, are non-refundable.

You may transfer your seat to another person within your company any time prior to the first day of class through the "Modify Registration" link within the confirmation email or by emailing education@jondon.com.

You may move your registration to another class date for the same or equivalent value class so long as the request is sent to education@jondon.com more than 30 days prior to the first day of class. Transfer requests received less than 30 days prior to the start of class are not permitted due to the financial commitments we have incurred to the instructor, IICRC, or other training organization.

Jon-Don reserves the right to deny transfer requests not communicated in a timely manner in violation of the spirit of this policy.

"No shows" on any day of the class are not eligible for transfer, refund, or credit.

In the event that Jon-Don cancels one of our classes, registered students will be given the option to transfer their registration to another class date for the same or equivalent value class or receive a full refund. Jon-Don is not responsible for any losses students may incur relating to travel expenses.

6. LIMITATION OF LIABILITY

Upon registering for a class, students agree that they are personally responsible for their own safety and actions while attending classes at a Jon-Don facility. Students agree to comply with all Jon-Don policies and rules, including but not limited to all Jon-Don guidelines, signage, and instructions.

Students agree to indemnify, defend, and hold harmless Jon-Don, its agents, and its employees from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against Jon-Don, its agents, and its employees due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the Jon-Don facilities, tools, equipment, or materials, whether caused by the negligence of Jon-Don, its agents, and its employees.

7. PHOTO / IMAGE RELEASE

By registering for a class, students grant permission to Jon-Don, its agents, and its employees the irrevocable and unrestricted right to produce photographs and video taken of the registered individual while attending a class for any lawful purpose including publication, promotion, illustration, advertising, trade, or historical archive in any manner or in any medium by Jon-Don, unless student opts out in writing via emailing education@jondon.com prior to class. Registered students release Jon-Don and its legal representatives from liability for any violation or claims relating to said images or video.

Furthermore, registered students grant permission to use the statements given during an interview or evaluation with or without their name for the purpose of advertising and publicity without restriction to time limit or geographic area. Registered students waive all rights to any and all compensation stemming from the use of these materials.

8. CLASS MATERIALS, PROPRIETARY INFORMATION & INTELLECTUAL PROPERTY

Information and materials provided by Jon-Don or the instructor, including, but not limited to class manuals, downloads, PDFs, presentations, reviews, website content, and any other information, is either used under license by or is the property of Jon-Don. Materials and information may not be distributed, copied, or reproduced without exclusive written permission.

9. LIVE STREAM CLASSES

Students are responsible for providing their own Internet connection, laptop, webcam, and audio connection for Live Stream classes. Live Stream class connections are managed by the class Instructor. Connection info will be provided via email prior to the first day of class and therefore the student is responsible for providing a valid email address at the time of registration.

Students may not share a computer during a Live Stream class. Each student must have their own computer, webcam, and audio connection.

10. IICRC POLICIES & EXAM FEES

IICRC approved classes must follow IICRC policies. These policies include student requirements to be in class the entire time, on camera the entire time (if the class is live-streamed), viewed on a computer or tablet, not a phone (if the class is live-streamed), and the students must not be doing other work, including but not limited to driving, working out, talking on the phone, or any activity that would distract other students to be eligible to take the certification exam after class.

If a student does not meet these IICRC policies, and additional policies communicated in these terms, or on event pages, or communicated during classes, they will not be allowed to take the certification exam following the IICRC class. By registering and attending an IICRC approved class, you agree to these class policies.

IICRC Exam Fees are not part of the class registration fee, and are paid directly to the IICRC upon registering for your exam via the IICRC website at www.iicrc.org. To earn certification, students must pass the certification exam. If a student does not pass a class exam, they are not entitled to a refund or credit. 

11. STUDENT CONDUCT

If a student is distracting other students, using inappropriate language, not following class policies, or is causing issues that the instructor cannot properly instruct, the student will be removed from the class. Removal of a student from a class is at the discretion of the instructor. If a student is removed from the class, they will be given an explanation in writing and are not entitled to a refund for the class. If they are removed from the class, they will not be eligible to take the class exam for any IICRC certification class.
